Qualifying Persons
1.1 Definition of Promoter: Pick N Win ("the Promoter", "we", "us", "our") operates the website at https://www.picknwincompetitions.com ("the Platform") and provides skill-based prize competitions through the Platform. In these Terms, those competitions are referred to as "Pick N Win Competitions" or "Competitions".
1.2 Nature of Competitions: Pick N Win competitions are skill-based prize competitions. Entrants must correctly answer a skill-based qualifying question before an entry can be treated as valid. Each competition is operated in accordance with these Terms, the rules shown on the relevant competition page, and any other terms made available before entry.
1.3 Qualifying Persons: Competitions are open only to individuals who are aged 18 years or over, are resident in the Republic of Ireland, and meet all eligibility requirements stated in these Terms and on the relevant competition page.
1.4 No-Purchase Entry: Where a no-purchase postal entry route is available, valid postal entries are treated on equal terms with valid paid online entries and are included in the same result process for the relevant competition.
Nature of Our Competitions
2.1 Pick N Win operates skill-based prize competitions. Each competition is administered under published rules, stated entry limits, a closing date, and a skill-based qualifying question.
2.2 A correct answer to the skill-based qualifying question is required before an entry can be treated as valid. Questions are intended to involve skill, knowledge, judgement, reasoning, or attention, rather than being based purely on chance.
2.3 Where a no-purchase postal entry route is available, valid postal entries are treated on equal terms with paid online entries and are included in the same result process for the relevant competition.
2.4 The Platform is presented only as a skill-based competition service. Entrants should not submit an entry unless they have read and understood the applicable rules.
2.5 The Promoter may cancel, suspend, amend, or withdraw any competition where legal, regulatory, technical, operational, payment, fraud-prevention, or reputational concerns reasonably require it. Where a competition is cancelled by the Promoter, Section 7 applies.
2.6 In these Terms, the following definitions apply:
- Competition means a skill-based prize competition or prize promotion operated by the Promoter through the Platform.
- Entry means a valid submission to a Competition, whether by paid online entry or no-purchase postal entry, where all applicable conditions have been met.
- Entrant means an individual who submits or attempts to submit an Entry.
- Skill Question means the qualifying question that must be correctly answered for an Entry to be valid.
- Prize means the item, benefit, or award described on the relevant competition page.
- Prize Recipient means the Entrant verified as entitled to receive the Prize under the relevant competition rules.
- Result Process means the process described on the relevant competition page for identifying the Prize Recipient from valid eligible Entries after the competition closes.
- Entry Reference means the unique reference allocated to a valid Entry.
- Accountmeans the Entrant's registered account on the Platform.
Eligibility
3.1 To enter any competition, you must be aged 18 or over and be a resident of the Republic of Ireland, unless a competition page states otherwise.
3.2 Employees, directors, officers, contractors, agents, and immediate family members of the Promoter, or anyone professionally connected with the administration of a competition, are not eligible to enter unless the competition page expressly states otherwise.
3.3 The Promoter may require proof of age, identity, residential address, payment ownership, or eligibility at any time. The Promoter may refuse, void, or cancel any Entry and withhold any Prize where eligibility cannot be satisfactorily verified.
3.4 It is your responsibility to ensure that entering a competition is lawful in the place where you are located and that you are not prohibited from participating by law, employer policy, or any other restriction applicable to you.
Account Registration
4.1 Entrants must register an Account before submitting an Entry. All registration information must be accurate, complete, and kept up to date.
4.2 Each individual may hold only one Account. Creating multiple Accounts to avoid entry limits, account limits, verification checks, or any other restriction is a breach of these Terms.
4.3 You are responsible for keeping your login credentials secure. The Promoter accepts no liability for unauthorised access arising from your failure to keep those credentials secure. Contact us immediately at info@picknwincompetitions.com if you suspect unauthorised access.
4.4 The Promoter may suspend, restrict, or close any Account for breach of these Terms, suspected fraud, suspected abuse, failure to meet verification requirements, payment disputes, or where required by law.
Entry Routes
5.1 Competitions may be entered by:
- Paid online entry — by reviewing the competition rules, correctly answering the Skill Question, selecting the number of Entries within the stated limit, and completing payment through the approved payment provider; or
- No-purchase postal entry — by posting a handwritten entry in accordance with Section 6, where a postal entry route is available for that competition.
5.2 No purchase is necessary where a no-purchase postal entry route is available. Valid postal entries are handled on equal terms with paid online entries and are not disadvantaged in eligibility, timing, verification, notification, or Prize access.
5.3 Entries must be submitted individually. Bulk, automated, scripted, bot-assisted, third-party generated, or mechanically reproduced entries are prohibited and may be void.
5.4 The maximum number of Entries permitted per person per competition is shown on the relevant competition page. Entries above this limit may be void and may not be included in the Result Process.
5.5 A competition closes when the stated closing date is reached or the stated entry capacity is reached, whichever occurs first, unless the Promoter extends, suspends, or cancels the competition in accordance with these Terms.
5.6 The Promoter may refuse or void any Entry that is incomplete, illegible, late, non-compliant, fraudulent, abusive, or submitted in breach of these Terms or the competition-specific rules.
No-Purchase Postal Entry Route
6.1 Each postal entry must include the following, written clearly and legibly:
- Full legal name
- Date of birth
- Full residential postal address
- Email address
- Contact phone number
- Full name or reference of the competition entered
- Answer to the Skill Question for that competition
6.2 Each letter must contain one Entry for one competition only. Illegible, incomplete, bulk, duplicate, photocopied, automated, mechanically reproduced, or non-compliant entries may be rejected.
6.3 Postal entries must be received before the competition closing date, unless the competition page states a different deadline. The date of receipt, not the date of posting, is determinative. Late entries will not be included.
6.4The Promoter is not responsible for postal entries that are lost, delayed, damaged, misdirected, illegible, or not received for any reason outside the Promoter's reasonable control. Proof of posting is not proof of receipt.
6.5 Valid postal entries are entered into the same Result Process as valid paid online entries for the relevant competition.
Payments & Refunds
7.1 Paid online Entries must be paid in full before they are valid. Payment does not guarantee a Prize.
7.2 All payments are processed through a third-party payment provider. The Promoter does not store or access full card details. The Promoter is not responsible for payment processor outages, bank-side restrictions, card issuer decisions, or other issues outside its reasonable control.
7.3 Entries are generally non-refundable once submitted and confirmed, except where these Terms, the competition-specific rules, or applicable law require otherwise. Nothing in these Terms affects any statutory consumer rights you may have under Irish or EU applicable consumer law.
7.4 A refund may be provided where:
- a paid-entry competition is cancelled by the Promoter;
- a duplicate payment was taken in error;
- a material technical failure prevented an Entrant from receiving the paid online Entry and the issue cannot be corrected fairly;
- the Promoter is unable to award the Prize or provide a reasonable substitute;
- a refund is required by applicable consumer law; or
- the Promoter otherwise determines that a refund is appropriate.
7.5 Where a refund is due, it will ordinarily be returned to the original payment method within a reasonable timeframe. To request a refund, contact info@picknwincompetitions.com with your account details, competition name, and transaction reference.
7.6 Where a payment is reversed, disputed, subject to a chargeback, or identified as potentially fraudulent, the Promoter may suspend the associated Account, void the relevant Entries, and withhold any Prize pending investigation. The Promoter may report suspected payment abuse or fraud to its payment provider, bank, or relevant authorities.
Result Process & Verification
8.1 After a competition closes, the Prize Recipient is identified from all valid, eligible Entries received by the stated closing date using the Result Process described on the relevant competition page.
8.2 The Promoter may delay the Result Process for legal, technical, operational, payment, fraud-prevention, or verification reasons and will use reasonable endeavours to communicate material delays to Entrants.
8.3 Prize allocation is subject to verification. Before a Prize is released, the Promoter may require the selected Entrant to provide proof of identity, age, residential address, payment method, and eligibility. Acceptable documentation may include a current passport, driving licence, recent utility bill, bank statement, or other reasonable documentation.
8.4 If a selected Entrant cannot be contacted, fails verification, is found to be ineligible, refuses the Prize, or does not claim by the deadline of 15 days from notification, the Promoter may identify an alternative Prize Recipient from the remaining valid Entries using the same Result Process. The original selected Entrant will have no further claim.
8.5The Promoter's decision on the Result Process and Prize verification is final, subject to any legal rights an Entrant may have.
Prize Recipient Notification
9.1 Prize Recipients will be notified by email to their registered address, by phone, by in-platform notification, or by another method stated on the competition page.
9.2It is the Entrant's responsibility to ensure their contact details are accurate and up to date. The Promoter is not responsible for failure to notify a selected Entrant due to incorrect, outdated, or inaccessible contact details.
9.3 Prize Recipients must respond and claim their Prize within 15 days of notification. Section 8.4 applies if this deadline is not met.
Transparency Records
10.1 The Promoter may publish a Prize Recipient list or results archive on the Platform or its social media channels for transparency and promotional purposes. Published details may include first name, surname initial, general location such as county or region, competition entered, Prize received, and result date.
10.2Full personal details will not be published without the Prize Recipient's explicit prior consent, unless required by law.
10.3 Entry, result, verification, and payment records may be retained by the Promoter for audit, transparency, fraud prevention, legal compliance, complaints handling, and payment-provider requirements.
10.4 Entrants may request information about the result of a competition by contacting info@picknwincompetitions.com within a reasonable period after the relevant result date.
Prizes
11.1 The Prize for each competition is described on the relevant competition page. Images are illustrative only unless the competition page expressly states that the exact item depicted is the Prize.
11.2 Prizes are non-transferable and cannot be exchanged for cash unless the competition page expressly states otherwise. The Promoter may decide not to offer cash alternatives except where clearly stated in the competition-specific rules.
11.3 Unless stated otherwise on the competition page, Prize Recipients are responsible for any applicable taxes, insurance, registration, licensing, delivery arrangements, travel costs, and any other costs incidental to accepting or using the Prize. Where a Prize is a vehicle, the Prize Recipient may be required to arrange insurance, complete registration, and collect the vehicle in person.
11.4 For physical Prizes, the Promoter shall cover standard delivery costs for Prize Recipients located within Ireland unless the competition page states otherwise. Additional charges may apply for non-standard delivery, missed delivery, storage, re-delivery, or special arrangements requested by the Prize Recipient.
Participation Controls
12.1 Pick N Win is intended as a recreational skill-based competition platform. You should only submit paid online Entries where you are comfortable with the cost and understand that a Prize is not guaranteed.
12.2 The Promoter may make available account participation limits, entry limits, account pauses, cooling-off periods, or other account controls. To request these, contact info@picknwincompetitions.com or access them through your Account settings where available.
12.3The Promoter may restrict, suspend, or close an Account where participation patterns, behaviour, payment activity, or other information suggest potential harm, vulnerability, fraud risk, unauthorised use, or that continued participation may not be in the Entrant's best interest.
12.4 If you are concerned about your spending or financial wellbeing, you may wish to seek independent support from a recognised advice organisation. The following organisations can provide confidential support:
- GamblingCare.ie, including its national helpline.
- Gamblers Anonymous Ireland.
- Money Advice and Budgeting Service (MABS).
You can also pause participation, set personal spending limits, or contact support for help with account controls at any time.
Fraud Prevention, Verification and Compliance Checks
13.1 The Promoter may carry out age, identity, address, payment ownership, fraud prevention, source-of-funds, sanctions, anti-money laundering, and eligibility checks at any time where reasonably required. The Promoter may request supporting documents before accepting Entries, releasing a Prize, processing a refund, or continuing to provide Account access.
13.2 The Promoter may immediately suspend an Account, void Entries, withhold Prizes, refuse payments, or close Accounts where there are reasonable grounds to suspect:
- fraud or attempted fraud;
- use of multiple Accounts;
- automated, bulk, bot-assisted, or mechanically reproduced Entries;
- chargeback abuse or payment manipulation;
- identity fraud, false information, or misrepresentation;
- collusion, cheating, or tampering with a competition or the Platform;
- unauthorised use of another person's payment method; or
- any other conduct the Promoter reasonably considers abusive or in breach of these Terms.
13.3 Where a Prize has been released to a person subsequently found to have acted fraudulently or in material breach of these Terms, the Promoter may seek recovery of that Prize or its equivalent value.
13.4 The Promoter may report suspicious activity to its payment providers, banks, regulators, law enforcement, or other competent authorities where required or permitted by law.
Prohibited Conduct
14.1 The following conduct is prohibited and may result in Account suspension or closure, Entry voidance, Prize forfeiture, and referral to relevant authorities:
- Operating more than one Account.
- Using automated software, bots, scripts, or third-party entry tools.
- Colluding with other Entrants or any third party.
- Attempting to manipulate or interfere with any competition or the Platform.
- Providing false or misleading information at any stage.
- Reselling, transferring, assigning, or attempting to sell Entries.
- Abusing the chargeback or payment dispute process.
- Any other conduct the Promoter reasonably considers fraudulent, abusive, or in breach of these Terms.
Technical Errors & Platform Records
15.1The Promoter's back-end records of Entries, Entry References, result records, Account activity, and transactions are authoritative. In the event of any discrepancy between a user-facing display and the Promoter's internal records, the internal records shall prevail unless there is clear and demonstrable technical error.
15.2 The Promoter may delay, suspend, cancel, correct, or rerun a competition, Entry, Result Process, payment record, or Prize claim where affected by legal, regulatory, technical, operational, fraud, cyberattack, unauthorised access, manipulation, or obvious mistake concerns.
15.3 The Promoter does not warrant that the Platform will be continuously available or free from errors. The Promoter will use reasonable endeavours to correct technical issues promptly and to treat affected Entrants fairly.
Limitation of Liability
16.1Nothing in these Terms excludes or limits the Promoter's liability for:
- death or personal injury caused by the Promoter's negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot lawfully be excluded under Irish law or EU applicable mandatory legislation.
16.2 Subject to clause 16.1, the Promoter is not liable for:
- indirect, consequential, incidental, or unforeseeable losses;
- loss of profits, revenue, opportunity, or goodwill;
- technical failures, outages, payment-provider failures, or errors outside the Promoter's reasonable control;
- losses arising from incorrect contact details, user error, device failure, internet failure, postal delay, or third-party service outages.
16.3Subject to clause 16.1 and to the extent permitted by applicable law, the Promoter's total liability to any Entrant in respect of any one competition shall not exceed the total Entry fees paid by that Entrant for the relevant competition.
Data Protection
17.1 The Promoter processes personal data in accordance with its Privacy Policy. By registering an Account or submitting an Entry, you confirm that you have had the opportunity to read the Privacy Policy.
17.2 Personal data collected through the Platform may be used for account registration and management, Entry processing and administration, payment processing, result administration, Prize fulfilment, identity verification, fraud prevention and detection, account controls, legal and regulatory compliance, complaints handling, and marketing or promotional communications where consent or another lawful basis applies.
17.3 The Promoter processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679, the Data Protection Acts 1988–2018, and other applicable data protection laws. You have rights including access, rectification, erasure, restriction, portability, and objection. Please see the Privacy Policy for details.
Intellectual Property
18.1 All content on the Platform, including text, graphics, logos, images, software, code, and design elements, is the property of the Promoter or its licensors and is protected by applicable intellectual property laws.
18.2 Entrants may not reproduce, distribute, modify, scrape, copy, or create derivative works from any content on the Platform without the prior written consent of the Promoter.
Amendments
19.1 The Promoter may update these Terms at any time. The date of the most recent update is shown at the top of this document. Where a change is material, the Promoter will use reasonable endeavours to notify registered Entrants by email or in-platform notification.
19.2 Changes will not be applied retrospectively to competitions that have already closed or to Entries already submitted, except where required by law, to correct an obvious error, to address fraud or technical issues, or where necessary to comply with payment-provider, legal, or regulatory requirements.
19.3 Continued use of the Platform following a change constitutes acceptance of the updated Terms. If you do not agree, you should stop using the Platform.
Governing Law & Disputes
20.1 These Terms are governed by and construed in accordance with the laws of the Republic of Ireland.
20.2 Subject to clause 20.3, the courts of the Republic of Ireland shall have jurisdiction to settle any dispute arising from or in connection with these Terms.
20.3 Nothing in this clause affects any mandatory rights you may have under the consumer protection laws of your country of habitual residence to bring proceedings in the courts of that country or to rely on more favourable mandatory local law provisions.
20.4 If you have a complaint, please contact us first at info@picknwincompetitions.com. We will acknowledge your complaint promptly and aim to respond within 3 - 5 business days. If the matter remains unresolved, you may have further rights under Irish or EU applicable consumer protection law.
20.5 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
